A patent is the documented monopoly right of an inventor to use a product. Max Polyakov, for example, owns 6 patents for various technologies that he uses in his business.

Patent laws are territorial. In other words, there is no such thing as an “international patent.” Patents are granted and regulated by national and regional agencies and have different requirements in different countries. In order to protect his inventions in several countries, Max Polyakov uses the Patent Cooperation Treaty (PCT). But this procedure is more expensive and time-consuming.

Max Polyakov explained that the process of filing an application for the PCT procedure takes place in several stages:

  1. Submission of the international application to the Receiving Office in one of the established languages, where the application for compliance is conducted.

  2. Submission of the application to the International Searching Authority and receipt of an opinion on patentability.

  3. International publication of the application.

  4. Obtaining a national patent in each state specified in the application.

 

The whole process can take from 6 to 24 months.

 

In order to obtain a patent, the invention must satisfy three criteria:

  • Novelty – the solution must be previously unknown for a given area

  • Inventive level – the solution should not be obvious to a specialist in the field

  • Industrial applicability – the solution can be used in practice

Max Polyakov gave several recommendations before applying for patents on his technologies:

  • Examine existing patents. Only about 3% of patents all over the world enter the market, so if there is no competitive product on the market this does not mean that it is not patented.

  • Create a prototype. Many have to significantly change the design and technology in the product creation process, due to the prematurely filed patent application. In such circumstances, the patenting process also has to start anew. For example, Max Polyakov filed an application for the patenting of the online game “Slot Journey” only a year after its official release on the market.

  • Explore the market. It is possible that the market is so narrowly specialized that there is no sense in patenting your technology.
